TERMS OF SERVICEAs the artist I maintain the right to refuse a commission at any time and for any reason I see fit. You must be 18 or older to commission me regardless of the commission being sfw or nsfw.Please read carefully and make sure you understand the following terms before proceeding to my commission information.The following terms will cover timeline, payment, and scope of work.I. Timeline and scope of work● Commissions are started in the order they are received.
● All work will be completed in a timely manner. Please allow the artist adequate time to complete works.
● An estimated timeframe will be planned with the commissioner, but in the event that the artist cannot complete the art piece the commissioner will receive notice and a refund will be discussed depending on what stage the artist is at. (SeePayment/Refunds)
● A sketch will be submitted before proceeding with the final piece.
● Once the sketch has been approved design changes to the commission will be allowed for an additional fee. (See Revisions/Delays)
● A color commission will require a color pallet provided by the commissioner. If the commissioner does not have a pallet in mind the pallet will be created by the artist and must be approved by the commissioner before work on the final piece is started.II. Payment/Refunds● Accepted forms of payment: PayPal, venmo, and cash app
● The artist requires the commission be paid in full before starting the commission.
● Once the sketch is submitted to the commissioner and after revisions, if the commissioner is not satisfied with the sketch a refund of 70% will be given back to the commissioner. No further work will be done on the piece and no sketch will be given to the commissioner.
● If the artist is unable to start the commission a full refund will be given.
● If the artist is unable to complete the commission after the sketch has been approved a 70% refund will be issued along with the sketch.
● Once the commission is complete no refunds will be given.III. Revisions/Delays● The commissioner is allowed three (3) rounds of revisions to the commission piece during the sketching stage.
● When the first sketch is given the commissioner will make a list of up to 10 changes they need/want. This will allow for a total of three (3) rounds of revision for a total of thirty (30) changes in all.
● After the commissioner passes 30 changes any further revisions in the sketching phase will be subject to a fee per change dependent on what the change is. These changes and fees will be discussed prior to continuing the commission.
● Any changes to the commission after the sketch has been approved by the commissioner will be subject to a fee dependent on the change. Any changes and fees will be discussed before moving forward.
● The commissioner is allowed revisions to the color pallet before the commission will be started. (Only applied to commissions with color.)
● Any revisions to the color pallet after the pallet has been submitted and approved will be accepted within the limit of the three (3) rounds of revisions.
● Revisions to the completed commission will not be accepted.
● If delays occur due to the artist (such as personal, health, ect. reasons) a new estimated time frame will be discussed and given to the commissioner.
● Lack of response from the commissioner will push out the deadline or the commissioner may lose their position in the queue. Please respond within a timely manner to avoid this.IV. Copyright and Reproduction.The artist reserves the right to:
● Include the commission piece in portfolios, online profiles/pages, commission sheets, etc.
● Reproduce the artwork for merchandise (in the case of a fan art commission) such as prints, stickers, charms, etc.
● Modify, edit, and repurpose the commission piece.
● Claim the commission piece as their own work.The commissioner and other parties may not:
● Include the commission piece in their portfolios, online profiles/pages, commission sheets, etc.
● Reproduce the artwork for merchandise such as prints, t-shirts, stickers, etc.without an agreement or contract.
● Modify, edit, or repurpose the commission piece.
● Claim the commission piece as their own work.
● Post the commission piece online WITHOUT proper credits to the artist.
● Submit the commission piece to contests and submission calls.
● Make the commission into an NFT.
● Use the commission in any AI engines, learning, or other AI applications.
